2014年8月31日，十二屆全國人大常委會第十次會議經(jīng)表決，通過了關(guān)于設(shè)立烈士紀念日的決定，以法律形式將9月30日設(shè)立為烈士紀念日，并規(guī)定每年9月30日國家舉行紀念烈士活動。

2018年4月27日，十三屆全國人大常委會第二次會議通過的《中華人民共和國英雄烈士保護法》規(guī)定，國家和人民永遠尊崇、銘記英雄烈士為國家、人民和民族作出的犧牲和貢獻。國家保護英雄烈士，對英雄烈士予以褒揚、紀念，加強對英雄烈士事跡和精神的宣傳、教育，維護英雄烈士尊嚴和合法權(quán)益。此外，該法還規(guī)定，以侮辱、誹謗或者其他方式侵害英雄烈士的姓名、肖像、名譽、榮譽，損害社會公共利益的，依法承擔民事責(zé)任；構(gòu)成違反治安管理行為的，由公安機關(guān)依法給予治安管理處罰；構(gòu)成犯罪的，依法追究刑事責(zé)任。
